These Terms and Conditions ("Terms") govern your access to and use of our clinical software, mobile applications, and related services (collectively, "Services"). By creating an account or using our Services, you agree to these Terms.

1. Eligibility and Acceptance

By using our Services, you confirm you are authorised to act on behalf of a registered allied health or medical practice, or as an individual patient accessing the platform.
You must accept these Terms during account registration. If you do not agree, you may not use our Services.

2. Nature of the Services

Akuna Tec provides a software platform and mobile app to assist clinics and healthcare providers with managing patient information, prescribing exercises, storing medical data, and handling financial records.
Patients may access prescribed exercises and personal health information via the mobile app.

3. Data Security and Privacy

We comply with the Australian Privacy Act 1988 (Cth) and applicable healthcare privacy standards.
We take reasonable technical and organisational measures to safeguard personal, medical, and financial information stored through our Services.

4. User Responsibilities

You agree to use the Services only for lawful, professional purposes.
You must maintain confidentiality of your login credentials.
Clinics are responsible for ensuring their users (employees, contractors) comply with these Terms.
Patients accessing the app must keep their login details secure and are responsible for any activity under their account.

5. Subscriptions, Fees, and Trials

We offer paid subscription options, including monthly and annual plans.
A free trial period of 1 month is available to new clinic users. At the end of the trial, paid subscription is required to continue using the Services.

All fees are in Australian Dollars (AUD) and include applicable taxes unless stated otherwise.

Non-payment or failure to renew will result in suspension or termination of access.

6. Intellectual Property

All intellectual property in the Services, including software, branding, content, and associated materials, remains owned by ST Innovations Group Pty Ltd or our licensors.
Users may not copy, modify, reverse engineer, or distribute any part of the Services without our written consent.

7. Termination and Suspension

We may suspend or terminate access to the Services at any time for breach of these Terms, misuse, or illegal activity.
You may stop using the Services at any time; however, subscription fees remain payable for the agreed term.

8. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for any indirect, incidental, or consequential damages arising from your use of the Services.
Our total liability for any claim related to these Terms or the Services is limited to the amount paid by you in the 12 months preceding the claim.
Nothing in these Terms limits your rights under the Australian Consumer Law.

Our Services support healthcare practice management but do not replace professional clinical judgment.
We do not guarantee uninterrupted or error-free operation of the Services.

10. Changes to Terms

11. Governing Law

These Terms are governed by the laws of the Australian Capital Territory, Australia.
Any disputes will be subject to the exclusive jurisdiction of the courts in that territory.
